Terms and Conditions:
Holiday Cabinetry Terms and Conditions: All sales made by Holiday Cabinetry (“Seller”) to the Buyer (“Buyer”) are expressly conditioned upon Buyer’s acceptance of these Terms and Conditions. Seller shall not be bound by any terms contained in Buyer’s purchase order, acknowledgment, or other documents that are inconsistent with, additional to, or different from these Terms and Conditions. Any amendment, modification, or waiver of these Terms and Conditions shall be effective only if made in writing and signed by an authorized representative of Seller. Seller’s acceptance of an order, commencement of performance, shipment, or delivery of goods shall not be deemed or construed as acceptance of any additional or different terms and conditions proposed by Buyer.
Order & Cancellation: Buyer must review and confirm each new or revised order before it can be processed. Order changes may be made only prior to the commencement of assembly. Once assembly has begun, no order changes, cancellations, or modifications will be accepted unless approved in writing by Holiday Cabinetry. Any approved changes involving assembled cabinets shall be subject to a 5% restocking fee. The assembly fee is non-refundable. All custom, special-order, and made-to-order products are non-cancelable, non-returnable, and non-refundable once production has commenced or materials have been ordered.
Delivery Charges: Delivery charges are not included unless otherwise specified. Final delivery costs will be determined based on the delivery address provided by Buyer.
Payment method: We accept cash, company checks (payable to the invoiced company), or in-person credit card payments. A 3% processing fee applies to all card-not-present credit card transactions.
Return & Exchange: Prior to returning any products, Buyer must submit a completed Return Request Form to info@holidaycabinetry.com identifying all items to be returned. Unassembled cabinets and accessories approved for return shall be subject to a thirty percent (30%) restocking fee. Original shipping charges, delivery fees, assembly fees, and other service charges are non-refundable. Buyer shall be responsible for all return shipping and handling costs. Holiday Cabinetry reserves the right to reject any return request in its sole discretion. Requests for returns, replacements, shortages, shipping damage, or product defects must be submitted in writing within fourteen (14) days of delivery or pickup. No returns shall be accepted more than thirty (30) calendar days after the date of purchase. All returned products are subject to inspection and approval by Holiday Cabinetry prior to issuance of any credit. Credit memos will generally be issued within one to two business days following inspection and approval of the returned merchandise. Damaged, installed, modified, customized, special-order, or made-to-order products are not eligible for return. All returned merchandise must be in its original packaging and in resalable condition. Holiday Cabinetry reserves the right to substitute discontinued products or components with comparable products of equal quality and functionality.
Limitation of Liability: Seller’s liability shall be limited solely to the repair, replacement, or credit of the affected product, at Seller’s sole discretion. Under no circumstances shall Seller be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to labor costs, installation costs, project delays, lost profits, loss of use, or third-party claims.
Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.
Limited Warranty:
Holiday Cabinetry warrants its covered products to the original purchaser to be free from defects in materials and workmanship under normal residential use for a period of one (1) year from the original date of purchase.
Covered products include cabinet boxes, doors, drawer boxes, drawer fronts, drawer glides, hinges, and shelves.
This Limited Warranty applies only to the original purchaser and is non-transferable.
Holiday Cabinetry’s sole obligation under this warranty is, at its sole discretion, to repair, replace, or issue a credit for any covered product determined to be defective. Replacement parts may vary in color, grain, finish, or appearance due to natural aging, lighting conditions, manufacturing changes, or material availability.
To obtain warranty service, the purchaser must notify the Holiday Cabinetry distributor in writing within the warranty period and provide:
* Proof of purchase;
* Date and place of purchase;
* A description of the claimed defect; and
* Photographs of the defective product.
Holiday Cabinetry reserves the right to inspect any allegedly defective product before approving any warranty claim.
This warranty does not cover:
* Improper installation, misuse, abuse, neglect, accidents, alterations, or improper storage;
* Damage caused by water, excessive moisture, excessive humidity, extreme temperatures, fire, flooding, or other acts of God;
* Normal wear and tear, including expansion, contraction, warping within industry standards, fading, discoloration, or changes in wood grain or finish due to age or exposure to natural or artificial light;
* Damage resulting from improper cleaning products or maintenance;
* Labor charges, assembly or installation costs, removal, shipping, transportation, or reinstallation expenses;
* Consequential, incidental, indirect, punitive, or special damages of any kind.
Holiday Cabinetry reserves the right to discontinue or modify product designs, specifications, materials, finishes, or construction methods without notice and shall have no obligation to update or replace previously manufactured products.
Holiday Cabinetry shall have the sole discretion to determine whether a product qualifies for warranty coverage.
This Limited Warranty gives the purchaser specific legal rights. Other rights may vary from state to state.
THIS LIMITED WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY HOLIDAY CABINETRY AND IS IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
